Trib: Mt. Lebanon Parking Authority counters municipal merger offer; chairman resigns

The Mt. Lebanon Parking Authority is reluctant to move in with the municipality if it means giving up too much of its independence.

The authority's board of directors last night turned down a deal offered by the Mt. Lebanon commissioners that would have moved the authority offices into the municipal building and pared down its employees by eliminating positions, collecting fines through the municipal tax office and sharing tech support and office supplies.

At the end of the meeting, however, at least one job had been cut: Board Chairman Alfonso Frioni, Jr. resigned effective last night, later citing the stresses of the debates over the authority's future.

The Parking Authority just doesn't get it....the Municipality holds ALL the cards....it has the legal authority to appoint Board members and it has the legal authority to dismiss, remove or not reappoint members at will and without cause. The Authority reports to The Commission.

The municipality has guaranteed all the Authority debt and there is an additional, existing Operating Agreement in place (since 1993) that provides certain operating requirements of the Authority and added rights to the Municipality...which the Authority has not abided to or complied with in many instances.

The Authority just does not have any bargining power or rights other than to express opinions.

The Parking Authority Act of 1947 provided the right to the then township to establish the Parking Authority in 1954. One of the more silent and important roles of the Authority early on was acquiring land...called "land banking"... for future municipal controlled development under the oft-time pretense of need for public parking. Local governments were and still are not permitted to "land bank" directly, so parking authorities have served in that circumventing role for decades throughout PA. Now that the muni has established The Mt. Lebanon Partnership, which is a Community Development Corporation that can buy, hold for development, develop and/or sell real property, the Authority is no longer needed for "land banking". And, if the muni had the right to create the Authority, one presumes it has the power and authority to dissolve it, consolidate it and get on with it for Pete's sake !
